On November 4th, OSHA released their ETS requiring employers with 100 or more employees to have their employees vaccinated against COVID-19 or require weekly testing. This standard is currently being tested for validity at the federal court level, and this review could result in the ETS moving forward or being overturned. As we watch this play out at the federal level, it’s important that employers get their arms around implementing this new standard in the likely event that it moves forward.
